New York City: Ex-Marine Daniel Penny Walks Free

On Monday, December 9th, Ex-Marine Daniel Penny walked out of court a free man. He was the White ex-Marine charged in the chokehold death of Jordan Neely, a Black man.  After the verdict, Neely's father, Andre Zachery, was distraught, saying, "The system is rigged."

 

Here's why Andre Zachery is right:

 

Three men, including Daniel Penny, were holding Jordan Neely down. It was unfair to make Penny the fall guy or scapegoat. However, no one mentioned the role of the other two men.

- Yoran accused Penny's defense team of racism, especially in its jury selection process, yet never charged Daniel Penny with a Hate Crime. She had the power to remove any three jurors selected by the defense. If the defense removed her juror selections unfairly, Yoran could have also filed a prima facie motion to challenge the removal.

- After the jury had been deadlocked for just two days, Assistant DA Yoran recommended dismissing the manslaughter charge.

- Apparently, Assistant DA Yoran is a restorative justice advocate, which critics charge is a practice that is lenient on criminals. Yet, Alvin Bragg, the Manhattan District Attorney, selected Yoran for this case.

 

This trial was a farce maneuvered by the prosecutors. Assistant District Attorney Dafna Yoran is a very cunning Jewish woman. Her cries of racism fooled a lot of people. They thought she was an ally.

 

Even Donte Mills, the attorney for Jordan Neely's family, commended Yoran's efforts while criticizing the jury's acquittal.

 

Defense attorneys have limited resources, which puts them at a disadvantage compared to the prosecutor, who has access to a wealth of resources paid for by the taxpayer.  A GoFundMe page cannot compete with taxpayer dollars.

 

After the manslaughter charge was dismissed, Andre Zachery filed a civil lawsuit against Daniel Penny, maybe in anticipation of an acquittal. The despair that Zachery publicly displayed after the acquittal of his son's murderer was gut-wrenching.

 

However, no one should feel betrayed by their enemies. The problem has always been how to recognize the enemy.

 

America is a racist society that rapists, murderers, and thieves founded. They created a system that protected their interests and those with similar interests. Throughout American history, there have been efforts to divide society along racial, sexual, and economic backgrounds. This divisive status quo has been maintained throughout this country whether a male or female of European or African descent was at the helm at any political level. 

 

Of course, now, Daniel Penny can proudly proclaim that he would kill again if presented with the same opportunity, even at the risk of being called names by "a million people" because, as the great comedian Paul Mooney would say, Penny has the "complexion for the protection."

 

Penny will be a special guest of Vice President-elect J.D. Vance at the Army-Navy college football game on 12/14. He is the poster child for white vigilantism in America. In other words, a hero!
