Judge Rules for Protecting Students from Deportation for Criticizing Israel’s Genocide

 The Council on American-Islamic Relations (CAIR) today welcomed a federal court ruling affirming that the government cannot use immigration enforcement as a weapon to silence noncitizen students for constitutionally-protected political speech, including criticism of Israel’s genocide in Gaza and advocacy for Palestinian rights.

The ruling by U.S. District Judge Noël Wise is a significant victory for the First Amendment and for students, scholars, journalists and others who should be able to express their political views without fear that the government will retaliate against them because of what they say.

The Foundation for Individual Rights and Expression (FIRE) brought the lawsuit on behalf of Stanford University’s student newspaper.

In a statement, Washington, D.C.-based CAIR said:

“This ruling reaffirms a fundamental American principle that the government cannot deport people simply because it dislikes their political views.Students do not surrender their constitutional rights at the classroom door, and international students do not surrender their freedom of expression when they come to study in the United States. Criticizing the policies of a foreign government, including the genocidal government of Israel, is protected political speech.”
